THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No. 14471 of 2015 ORDER:

Heard learned counsel for the petitioner and learned Government Pleader for the respondents.

2. This writ petition is filed challenging the action of the respondents in seizing 3317 quintals of paddy, 436 quintals of rice and 416 quintals of broken rice from the premises of the petitioner under a panchnama dated 03.05.2015.

3. The learned counsel for the petitioner submits that after filing of the writ petition, 6A proceedings were initiated and the seized stock included in the present writ petition does not belong to the licensee and the rice seized and included in the writ petition belongs to some ryots and was sent for milling purpose. However, this Court is not inclined to consider the plea, in view of the pendency of 6-A proceedings before the 2nd respondent. It is open to the petitioner to file an appropriate application seeking release of the seized stock before the 2nd respondent within a period of one week from the date of receipt of a copy of the order and the 2nd respondent, after receipt of the said application, shall consider the same in accordance with law and pass appropriate orders within one week thereafter.

4. The Writ Petition is accordingly disposed of. Miscellaneous petitions, if any, pending in the writ petition shall stand closed. There shall be no order as to costs. ________________________________ (A.RAMALINGESWARA RAO, J) 8th June, 2015 cbs
