THE HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION NO.7085 OF 2001 ORDER:

This writ petition is filed seeking to issue a writ of mandamus declaring the action of the respondents in reducing the pay of the petitioners fixed at Rs.1475/-p.m., as on 1.1.1993 in the time scale of Rs.1375-25-1475-30-1625-40-1825-50-2075-60-2375 under Revision of Pay Scales, 1993 issued in G.O.(P) No.162, Finance and Planning (FW.PC.I) Department, dated 20.5.1993 and in fixing the initial pay of the petitioners at Rs.1375/- p.m., with effect from 1.2.1994 by virtue of the modified orders issued in G.O.(P) No.18, Finance & Planning (FW.PC.I) Department, dated 19.1.1994 as illegal and arbitrary, and consequently, to direct the respondents to permit the petitioners to draw the pay of Rs.1475/- with effect from 1.1.1993 as fixed under G.O.(P) No.162, Finance and Planning, dated 25.5.1993.

Heard Smt. D. Padmavathi, learned Counsel for the petitioners and the learned Government Pleader for Finance and Planning. 3.

It has been submitted by the petitioners that they were appointed as attenders and they were working as such in the 2nd respondent-Secretariat, and their pay was fixed at Rs.1475/- as on 1.1.1993, but the respondents on the ground of refixing their pay in terms of G.O.(P) No.18, dated 19.1.1994 reduced their pay to that of Rs.1375/- and challenging the same, the present writ petition has been filed.

The learned Counsel for the petitioners submits that during the pendency of this writ petition, the petitioners have submitted a

representation to the respondents on 23.7.2004. The said fact was not disputed by the learned Government Pleader for Finance and Planning. 5.

The learned Counsel for the petitioners further submits that ends of justice would be met if the respondents are directed to dispose of the said representation, within a reasonable period of time. The learned Counsel for the 2nd respondent has not opposed the said submission. 6.

In view of the submissions made by the Counsel, this Court is of the view that without expressing any opinion on merits, this writ petition can be disposed of directing the respondents to consider the representation of the petitioners dated 23.7.2004.

Accordingly, the Writ Petition is disposed of directing the respondents to consider the representation submitted by the petitioners on 23.7.2004 and pass appropriate orders, within a period of eight weeks from the date of receipt of a copy of this order.
