HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.8481 OF 2017 ORDER:

This Writ Petition is filed challenging the show cause notice, dated 13.02.2017, issued by the 3rd respondent-Deputy Direcotr of Mines & Geology, Guntur.

The impugned show cause notice issued by the 3rd respondent had required the petitioner to submit his objections, if any, with respect to his lease application dated 16.04.2015 for grant of quarry lease for road metal and gravel, over an extent of 120.396 Hectares, situated in Sy.No.221 of Ananthavaram Village and Sy.No.484 of Neerukonda and Bethapudi villages. Inasmuch as, learned counsel for the petitioner though raised various grounds and urged before this Court, it is not necessary for this Court to deal with the same, as it is only a show cause notice and petitioner has ample opportunity to submit his explanation. As the time granted on 13.02.

2017 has expired as of date, interest of justice would be served if an opportunity is given to the petitioner to make his objections, including the grounds raised in this writ petition, before the 3rd respondent subject to the condition of petitioner submitting his explanation and objections within 10 days from today, and the same shall be considered by the respondent authorities and pass appropriate orders. Accordingly, the Writ Petition is disposed of.There shall be no order as to costs.

Consequently, the Miscellaneous Petitions, if any pending, shall stand closed.
