S.Bala Brahma Gupta v. The Honble Lok Adalath Bench At Kurnool
THE HON'BLE SRI JUSTICE RAMESH RANGANATHAN And THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY Writ Petition No.9393 of 2015 ORDER: (per Hon'ble Sri Justice Ramesh Ranganathan) The writ petition as filed is wholly misconceived. The proceedings under challenge in this writ petition is the award passed by the Lok Adalat Bench at Kurnool dated 08.10.2014 holding that petitioners 1 to 9 were the legal representatives of late Sri Ramadasu; petitioners 1 to 4 alone had an absolute right, title and possession over the subject land; and petitioners 5 to 9 were not going to claim any right, in respect of petitioners 1 to 4, in the said land. The petitioners in this writ petition claim not to be parties to the proceedings before the Lok Adalat. The award passed on 08.10.2014 would only bind the parties to the proceedings before the Lok Adalat. As the petitioners claim not to be parties before the Tribunal, it is open to them to avail such other remedies as are available to them in law.
The writ petition is, accordingly, dismissed. Miscellaneous petitions pending, if any, shall also stand dismissed. There shall be no order as to costs.
