THE HON'BLE SRI JUSTICE T. SUNIL CHOWDARY WRIT PETITION No.34110 of 2016 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking a Writ of Mandamus to declare the inaction of the 5th respondent in disposing of the representations of the petitioners dated 08.06.2016 as illegal and arbitrary. Heard the learned counsel for the petitioners, the learned Government Pleader for Panchayat Raj & Urban Development, the learned Government Pleader for Revenue and Sri Ravi Cheemalapati, the learned standing counsel for the Gram Panchayat.

It is the case of the petitioners that the 5th respondent has not completed the drainage channel work since two years. It is the case of the petitioners that due to non-completion of the work, the villagers are facing much difficulty. A perusal of the record reveals that the petitioners have submitted a representation to the 5th respondent on 08.06.2016. For one reason or the other, the 5th respondent has not considered the said representation of the petitioners.

At the time of arguments, the only request made by the learned counsel for the petitioners is to direct the 5th respondent to dispose of the representation submitted by the petitioners on 08.06.2016. The learned counsel for the respondents also consented for the same.

In view of the submissions made by both counsel, this Court is not inclined to go into the merits of the case. Having regard to the facts and circumstances of the case and the submissions made by both counsel, the fifth respondent is hereby directed to consider and dispose of the representation made by the petitioners on 08.06.2016 as expeditiously as possible, preferably, within a period of one month from the date of receipt of a copy of this order.

With the above direction, this writ petition is disposed of. As a sequel, miscellaneous petitions pending in this writ petition, if any, shall stand closed.
