ORDER

Petitioner, who is arrayed as accused, in C.C.No.267 of 2022 on / t l the file of the I Additional Judicial First Class Magistrate at lVlancherial, registered for the offences under Sections 406 and 420 of lPC, is seeking to quash the proceedings against him.

Heard Mr. Suresh Shiv Sagar, learned counsel for the petitioner and Mrs. S.Madhavi, learned Assistant Public Prosecutor appearing for the respondenlState and perused the record. 3.

Though the petition is filed for quashing the proceedings, during the course of arguments, learned counsel for the petitioner has restricted his prayer to the extent of dispensing with the presence of the petitioner-accused before the trial Court.

Hence, this petition is disposed of dispensing with the appearance of the petitioner-accused before the trial Court unless his presence is specifically required during the course of trial, subject to the condition of petitioner being represented by his counsel on every date of hearing. ln case of non-appearance of the petitioner-accused on the specific dates fixed by the trial Court for his personal appearance, this order gets vacated automatically.
