THE HON'BLE SRI JUSTI CE T.VI NOD KUMAR WRI T PETI TI ON No.21386 of 2019 ORDER:

The present writ petition is filed to declare the action of respondents 3 and 4 in registering FIR against the petitioners in Crime No.261 of 2019 on the file of the Siddipet Rural Police Station, Siddipet District, as illegal and arbitrary.

Despite the matter was adjourned twice, there was no representation for the petitioners. Even today also, there is no representation for the petitioners.

Learned Assistant Government Pleader for Home, on written instructions, dated 23.10.2019, submits that basing on the complaint made by one Peddasaigari Yadagiri, who is the fifth respondent in the writ petition, a case in Crime No.261 of 2019 on the file of Siddipet Rural Police Station was registered on 23.09.2019 and the authorities took up investigation in the matter. He would further submit that during the course of investigation, L.W.1 was examined and his statement was recorded and that the matter is still under investigation for collection of evidence. Learned Assistant Government Pleader also submits that so far no efforts were made to arrest the accused persons and that the authorities would follow the guidelines envisaged by the Apex Court in ARNESH KUMAR V. STATE OF BIHAR1 Having regard to the said submission on behalf of the official respondents, no further orders are need to be passed in this writ petition.
