HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR W.P.No.6231 of 2015 ORDER:

Heard.

The petitioners complain of actions of the third parties, who alleged to have damaged the crops raised by them in the land admeasuring Ac.6-27 cents in Sy.No.28 situated at Makkinavarigudem Revenue Village, T.Narsapuram Mandal, West Godavari District. The petitioners made a complaint regarding such illegal acts by approaching the 3rd respondent and complains that no action is taken by the 3rd respondent.

Learned Government Pleader has received instructions, which state that the manuscript complaint of the petitioners was received by the 3rd respondent on 0511-2014 and the same was entered in the Station General Diary of T.Narasapuram Police Station. The enquiry made by the 3rd respondent including the report of the Tahsildar show that the aforesaid land is stated to be a Government land and there appears to be a civil dispute between the petitioners and third parties. Hence, the petitioners were advised to approach the Civil Court to settle the dispute and no further action was warranted on the complaint of the petitioners. In view of necessary enquiry having been made by the 3rd respondent and as the land in question is a Government land, the petitioners are at liberty to approach the civil court and seek redressal of their grievance against third parties. Accordingly, the writ petition is disposed of. No order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed. _______________________ VILAS V.AFZULPURKAR, J Date: 02-04-2015 Prv
