HON'BLE SRI JUSTICE P.NAVEEN RAO CONTEMPT CASE No.2487 of 2016 ORDER:

An order of status quo was granted in WPMP.No.46733 of 2014 in Writ Petition No.37335 of 2014, dated 05.12.2014. Alleging that in spite of the said order of status quo, the respondents are interfering with the petitioners' possession and enjoyment of the property and thereby, violated the directions issued by this Court, this Contempt Case is filed. Counter-affidavit is filed on behalf of the third respondent. In para-6 of the counter-affidavit, it is categorically asserted that the respondents have not violated the order of status quo and have not interfered with the lands in question subsequent to the interim order passed by this Court. In fact, it is the assertion of the third respondent that Survey No.1/1A of Asakapalle Village and Survey No.142/2 of Iruvada Village of Sabbavaram Mandal does not exist in the revenue records. The petitioners on the basis of the fabricated documents are claiming the lands in the said Survey numbers as belonging to them and there is a large extent of Government land in that area.

This assertion of the respondent is not denied by the petitioners.

Having regard to the categorical stand of the third respondent in the counter-affidavit, it is evident that the aforementioned order of this Court has not been violated. No contempt is made out and the Contempt Case is, accordingly, dismissed. _____________________ JUSTICE P.NAVEEN RAO 13th June, 2017 DR
