Vide the Judgment dated 07.08.2025 in L.A.A.S.No.619 of 2025, this Court while dismissing the appeal filed by the petitioner, granted three months time to the petitioner to comply with the order passed by the learned Reference Court.
Petitioner filed the present application seeking extension of the said time for three more months contending that it has filed SLP vide Special Leave to Appeal No.9543 of 2026, which was dismissed by the Apex Court on 20.03.2026. Petitioner was running in losses and it is facing financial crises. Therefore, this application is filed for extension of time.
Whereas, Mr.K.S.Sunil Kumar, learned counsel for respondent Nos.1 and 2, would contend that Award was passed on 30.05.1989. At the instance of respondent No.3, a reference was made before the Civil Court. Learned Civil Court passed a Judgment dated 19.06.2006. Challenging the said Judgment, petitioner preferred the appeal vide L.A.A.S.No.619 of 2025, which was dismissed vide Judgment dated 07.08.2025. Therefore, petitioner filed the
present application only to harass respondent Nos.1 and 2. However, considering the fact that the petitioner has already preferred an appeal challenging the Judgment dated 07.08.2025 in L.A.A.S.No.619 of 2025 and the same was dismissed on 20.03.2026, the time granted by this Court vide Judgment dated 07.08.2025 in L.A.A.S.No.619 of 2025 is extended for one more month from today. Therefore, petitioner shall deposit 50% of the awarded amount within one month from today and balance amount shall be deposited within one month thereafter. On such deposit, respondent Nos.1 and 2 are at liberty to withdraw the same, without furnishing any security.
