THE HON'BLE SRI JUSTICE V. RAMASUBRAMANIAN AND THE HON'BLE SRI JUSTICE G. SHYAM PRASAD WRIT APPEAL No. 1053 of 2016 JUDGMENT: (Per VRS,J) The Andhra Pradesh State Seeds Development Corporation has come up with the above appeal, challenging an order passed by the learned single Judge allowing the writ petition of the 1st respondent herein.

Heard Mr. M. Srinivasa Rao, learned counsel for the appellant. Mr. M. Srikanth, learned counsel, takes notice for the 1st respondent. 3.

The main grievance of the appellant Corporation is that after service of notice in the writ petition, they had entered appearance through counsel, but unfortunately, the name of their counsel was not mentioned in the cause list. But, the learned single Judge allowed the writ petition, on the ground that there was no appearance on their behalf.

The above facts are not and cannot be disputed, as seen from the records. Therefore, we are of the considered view that the appellant deserves an opportunity of being heard.

Hence, the Writ Appeal is allowed, the order of the learned single Judge is set aside, and the matter is remitted back. The appellant shall file a counter to the main writ petition within two (2) weeks, and within two (2) weeks thereafter, the matter shall be listed before the concerned learned single Judge.
