THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 21423 of 2019 ORDER:

This Writ Petition is filed for the following relief: "....to issue writ order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the 2nd respondent in not considering the representation of the petitioner dated 18.08.2015 and 23.09.2019 as illegal arbitrary unjust unreasonable and contrary to Article 14 of the Constitution of India and consequently direct the respondent No 2 to consider and dispose of the representation of the petitioner dated 18082015 and 23092019 duly stopping the constructions made by the 8th respondent in the land of the Petitioner admeasuring Ac 0.15Guntas or 1815 Sq yards of land in Sy No 34 situated at Shayampet Village, Hanamkonda Mandal, Warangal Urban District, duly considering the representations of the petitioner dated 18.08.2015 and 23.09.2019."

The prayer sought by the petitioner is neither feasible nor permissible for the municipal authorities to enquire as to whether the eighth respondent is making construction in a particular Survey Number or in the Survey Number as asserted by the petitioner, particularly, in the absence of approved layout. In those circumstances, this Writ Petition is closed by granting liberty to the petitioner to avail the remedies as available to him under civil law.

Miscellaneous Petitions, if any pending, shall stand closed. There shall be no order as to costs.
