THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.11908 of 2015 ORDER:

This Criminal Petition is filed by the petitioners-accused Nos.2 & 3 under Section 438 Cr.P.C. seeking anticipatory bail in Crime No.98 of 2014 on the file of Salur Town P.S., Vizianagaram District, registered for the offences punishable under Sections 498-A, 109, 307 and 34 IPC and 3 & 4 of the Dowry Prohibition Act. The petitioners are the mother-in-law and sister-in-law of the de facto complainant. The allegation against the petitioners is that they used to harass the de facto complainant demanding additional dowry. Learned counsel for the petitioners submitted that the petitioners are innocent of the offences alleged against them and they never harassed the de facto complainant.

Learned Public Prosecutor submitted that after investigation, the police filed charge sheet and NBWs are pending against the petitioners. In view of the same, this Court is not inclined to grant anticipatory bail to the petitioners. However, the petitioners are directed to appear before the Court concerned and file a petition to recall the warrants issued against them and on such filing of a petition, the trial Court is directed to recall the warrants on the same day on their execution of bond for a sum of Rs.10,000/- (Rupees ten thousand only) each with one surety for a like sum each. Further, the petitioners are directed to appear before the trial Court regularly.

With the above directions, the Criminal Petition is disposed of. _____________ RAJA ELANGO, J November 23, 2015 KTL
