This criminal petition is filed seeking for quash of the proceedings passed in C.C.No.63 of 2015 on the file of the Judicial First Class Magistrate, Mancherial.

Heard learned counsel for the petitioners and learned Public Prosecutor and with their consent, the criminal petition is disposed of at the admission stage.

The counsel for the petitioners contends that the complaint is filed merely to harass the petitioners, who are no way concerned with the affairs of the family of the complainant and her husband. But a perusal of the complaint would show that the allegations though are not very specific, are nevertheless made against A2 to A6, the allegations consist of insistence of complainant to ask money from her parents and that they were abetting A1 to harass the complainant and there are also allegations that they were also harassing her along with A1. Hence, it cannot be straightaway said that there is no basis in the allegations and truth needs to be brought out only after due trial. However, the counsel for the petitioner contends that NBWs are issued against the petitioners at the instance of the complainant though they were not absconding and that summons were not served on them. 4.

In view of the above, I deem it fit to direct the Court below not to insist upon the presence of the petitioners during trial unless their presence is necessary for further trial. So also the Court below shall

entertain the petitions filed by the petitioners for recall of their NBWs and dispose of the petitions on the same day. With the above directions, the criminal petition is disposed of. As a sequel, the miscellaneous applications, if any pending, shall stand closed.
