THE HONOURABLE SRI JUSTICE P.KESHAVA RAO WRIT PETITION No.1406 of 2015 ORDER:

Heard learned counsel for the petitioners and the learned Government Pleader appearing for the respondents 1 to 3.

2. The prayer sought in the writ petition is as under: ".....to issue order or orders more particularly one in the nature of writ of mandamus declaring the inaction of the respondents herein in registering the crime in pursuance of the complaint dated 23.12.2014 made by the petitioners and seeking the protection against the assailant as illegal arbitrary discriminatory violation of Article 21 of the Constitution of India"

3. When the matter is taken up for arguments, learned Government Pleader placed on record the written instructions, dated 07.02.2015 submitted by the Sub-Inspector of Police, Jeedimetla, Police Station, Cyberabad Commissionerate. A perusal of the said instructions would reveal that pursuant to the compliant dated 23.12.2014 lodged by the petitioners, when the preliminary enquiry was under progress, the petitioners approached the 2nd respondent police station and stated that their elders settled the matter between them and their son and their son agreed to live separately and also had given 8 tulas of gold, cash of Rs.90,000/- to their daughter-in-law Smt. Suguna and settled the matter out of court. In those circumstances, they requested the police not to take any action against their son including registration of any case. A copy of the letter submitted by the petitioners to the 3rd respondent is enclosed to the said written instructions. In the said letter, the petitioners have

reiterated what is that is mentioned in the written instructions as stated above.

4. In that view of the matter, this Court is of the opinion that no further cause would survive in the writ petition and the same is liable to be dismissed.

5. Accordingly, the writ petition is dismissed. No order as to costs. Miscellaneous Applications, if any pending, shall stand closed. ____________________ P. KESHAVA RAO, J August 29, 2019.
