HON'BLE SRI JUSTICE T.SUNIL CHOWDARY WRIT PETITION NO.31846 OF 2016 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking a writ of Mandamus declaring the action of the respondents in issuing the auction notification, dated 10-09-2016 as illegal and arbitrary. 2.

Heard learned counsel for the petitioners and the learned Government Pleader, representing respondents 1 to 4. 3.

It is the case of the petitioner that he participated in the public auction conducted in the year 2014 and became highest bidder and bid was knocked down in his favour. The grievance of the petitioner is that he made a representation to the 4th respondent on 07-05-2016 with a request to extend lease period. Pending representation, 5th respondent issued auction notice.

At the time of arguments, the only relief sought for by the learned counsel for the petitioner is to direct the 4th respondent to dispose of the representation of the petitioner, dated 07-05-2016.

In view of submission made by the learned counsel for the petitioner, this Court is not inclined to go into the merits of the case.

Having regard to the facts and circumstances of the case, the 4th respondent is hereby directed to dispose of the representation of the petitioner, dated 07-05-2016 as expeditiously as possible preferably within a period of 15 days from the date of receipt of a copy of this order.

Accordingly, this writ petition is disposed of. No order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
