THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO.7660 OF 2023 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner/Accused No.1 in Crime.No.108 of 2023 on the file of Kamepally Police Station, Khammam District, registered for the offences under Sections 143, 148, 294-b, 341, 324 and 307 r/w. 149 & 1209b) of IPC.

Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the respondentState and perused the record. 3.

The petitioner is arrayed as A-1. The case of the Police is that this petitioner along with 14 others formed into unlawful assembly and attempted to murder the victim. The said attack was on account of this petitioner and another accused-A-2 conspiring and instigating A-3 to A-15 to kill the de-facto complainant/LW.1.

Learned Additional Public Prosecutor on instructions would submit that the victim was treated and discharged from the hospital. It is not disputed that all the other accused have already been released on bail. 5.

In the said circumstances, this Court deems it appropriate to grant the relief of regular bail to the petitioner, subject to following conditions:

i) The petitioner/Accused No.1 shall execute personal bond for a sum of Rs.50,000/- (Rupees Fifty thousand only) with two sureties for a like sum each to the satisfaction of Judicial Magistrate of First Class (Special Mobile) at Khammam.

ii) The petitioner/Accused No.1 after release shall appear before the concerned Station House Officer at 10:00 a.m. everyday for a period of three weeks and thereafter, as and when required for the purpose of investigation.

iii) The petitioner/Accused No.1 shall abide by the other conditions stipulated in Section 437(3) of Cr.P.C.

Accordingly, this Criminal Petition is allowed. Miscellaneous applications, pending if any, shall stand closed.
