HON'BLE SRI JUSTICE M. SATYANARAYANA MURTHY CRIMINAL PETITION No.2571 of 2017 ORDER :

This criminal petition is filed under Section 438 of the Code of Criminal Procedure, 1973 (for short, 'the Cr.P.C.') to enlarge the petitioner/accused No.1 on bail in the event of his arrest in connection with Crime No.1129 of 2016 of Rajendranagar Police Station, Cyberabad, registered for the offences punishable under Sections 408, 420 and 379 IPC and Sections 65 and 72 of the Information Technology Act, 2008.

After arguing the matter elaborately, learned counsel for the petitioner, requested this Court to direct the Station House Officer, Rajendranagar Police Station, to issue notice under Section 41-A of the Cr.P.C. and also follow the guidelines issued by the Hon'ble Apex Court in Arnesh Kumar v. State of Bihar1 3.

It is needless to mention here that this Court need not given any direction as it is mandate of Apex Court to follow the guidelines issued in Arnesh Kumar's case supra, otherwise it would amount to contempt of Court being filed High Court of concerned State. Hence, the Investigating Agency is bound to adhere to the guidelines issued by the Apex Court in Arnesh Kumar's case supra. 1 (2014) 8 SCC 273

With the above observation, the criminal petition is disposed of. 5.
