ORDER
This petition under Section 482 Cr.P.C. is filed by the petitioners/A2 and A3 seeking to quash the proceedings in C.C.No.226 of 2012 on the file of Judicial First Class Magistrate (Special Mobile Court), Khammam, Khammam District, registered for the offence punishable under Section 498-A IPC and under Sections 3 and 4 of Dowry Prohibition Act, against them.
2. It is alleged in the charge sheet that A1, at the instigation of A2 to A7, used to harass his wife i.e., de facto complainant, mentally and physically by demanding additional dowry, beat her and necked her out from the matrimonial house. Based on the complaint, a case in Cr.No.52 of 2012 under Section 498-A IPC and under Sections 3 and 4 of Dowry Prohibition Act, was registered against the accused.
3. Since there are certain allegations mentioned in the charge sheet, the matter has to be decided after full fledged trial and therefore, this Court is not inclined to interfere with the impugned proceedings.
4. At this stage, learned counsel for the petitioners confined his argument to the extent that the presence of petitioners/A2 and A3 may be dispensed with.
5. Considering the said facts and circumstances of the case, the presence of petitioners/A2 and A3 before the trial Court is dispensed with except on the dates whenever their presence is insisted by the trial Court and they shall be represented by their
counsel.
6. With the above direction, the Criminal Petition is disposed of. Miscellaneous petitions, if any, pending in this petition shall stand closed.
