Heard the learned Counsel for the petitioner. The case of the petitioner is that he was doing a road work before his commercial complex situated adjacent to the third respondent hospital with the help of a JCB bearing No.AP 27 N 1406. He states that there is a HT electricity line going into the hospital through underground cable and due to the work undertaken by him, the cable was cut, as a result of which a short circuit happened in the third respondent hospital. The computers and other electronic equipment were burnt down. In that connection, the third respondent lodged a complaint with the Police showing the unnamed driver as an accused. When the Police issued a notice under Section 41-A of the Code of Criminal Procedure to the petitioner on 16.02.2017, the present Writ Petition was filed.

This Court sees that the Police are invoking the provisions of Code of Criminal Procedure in connection with registration of FIR No.212 of 2017 dated 31.01.2017. The Police cannot be prevented from investigating the case in a lawful manner. No ground is shown for entertaining the present Writ Petition, except challenging the notice issued under Section 41-A of the Code of Criminal Procedure.

In the circumstances, the Writ Petition is dismissed. The miscellaneous petitions pending in this Writ Petition, if any, shall stand closed. There shall be no order as to costs. ________________________________ (A.RAMALINGESWARA RAO, J) 27.02.2017 vs
