HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.19698 OF 2016 ORDER:
The case of the petitioners is that they were issued notice dated 31.05.2016 by the 3rd respondent under Section 7 of the Land Grabbing Act, 1905 and the same is being challenged in the writ petition stating that they were in possession of the said land from the last 50 years.
Heard the learned Senior counsel S.Satyam Reddy and the learned Assistant Government Pleader for Revenue.
Normally this Court will not interfere with the show cause notice unless it is issued without jurisdiction. Therefore, it is for the petitioners to file their objections or explanation to the said notice within a period of one (1) month from today. On such submission of objections or explanation, the competent authority may consider the same and pass appropriate orders. Till such time, status-quo obtaining as on today shall be maintained. However, if the petitioners fail to file their objections or explanation within the aforesaid period, it is open for the respondents to take appropriate action in accordance with law. With the above direction, the writ petition is disposed of. There shall be no order as to costs.
