This Criminal Petition is filed under Section 482 of the Code of the Criminal Procedure, 1973, seeking to quash the proceedings in SC/(POCSO)/72/2019 on the file of I Additional District and Sessions Judge, Mahabubnagar, Mahabubnagar District, pursuant to the complaint dt.30.05.2018.
charge sheet came to be filed against the petitioner/A.3 for the offences punishable under Section 366, 376(2)(n) r/w. Section 109 of IPC and Section 5(1) r/w. Sections 6 and 17 of POCSO Act, 2012.
Though the present Criminal Petition is filed seeking quashing of entire proceedings against the petitioner, learned counsel for the petitioner restricts his prayer seeking dispensation of the presence of the petitioner before the trial Court on every date of adjournment.
The learned Public Prosecutor submits that since the identity of the petitioner is not in dispute, his presence in the above C.C. may not be necessary on every date of adjournment.
Having regard to the facts and circumstances of the case, personal appearance of the petitioner/A.3 in SC/(POCSO)/72/2019 on the file of I Additional District and
GSD, J Crl.P.No.6210 of 2019 Sessions Judge, Mahabubnagar, Mahabubnagar District, is hereby dispensed with while permitting him to mark his appearance through his counsel, except on the dates when his presence is specifically required by the said Court. With the above direction, this Criminal Petition is disposed of.
As a sequel, miscellaneous petitions pending, if any, shall stand closed.
