THE HON'BLE THE CHIEF JUSTICE SRI KALYAN JYOTI SENGUPTA AND THE HON'BLE SRI JUSTICE SANJAY KUMAR Public Interest Litigation No.116 of 2014 DATED:09.02.2015 Between:
Addanki Raja, Secunderabad.
... Petitioner And The State of Telangana, Represented by its Chief Secretary, Department of Energy/Electricity, Hyderabad and others.
....Respondents
THE HON'BLE THE CHIEF JUSTICE SRI KALYAN JYOTI SENGUPTA AND THE HON'BLE SRI JUSTICE SANJAY KUMAR Public Interest Litigation No.116 of 2014 Order: (per the Hon'ble the Chief Justice Sri Kalyan Jyoti Sengupta) It appears that being inspired with the news item in a few daily newspapers alleging negligence with regard to not switching off the street lights during the day time, the petitioner approached this Court seeking a Mandamus commanding the respondents to discharge its duty.
No demand of justice has been made to the real respondents or the persons who will take action. However, the Court in spite of this lacuna entertained the petition and invited counter affidavit. In the counter affidavit, the Greater Hyderabad Municipal Corporation has promised that they will be careful in using the electricity and prevent any abuse or misuse of energy by taking all measures.
In view of this statement and averment made in the counter affidavit, we close the Public Interest Litigation directing the Greater Hyderabad Municipal Corporation to see that the statement made before the Court is followed without fail.
Consequently, the miscellaneous applications, if any pending, shall also stand closed. No order as to costs. __________________ K.J. SENGUPTA, CJ
