HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.40418 OF 2016 ORDER:

The petitioner prays for Mandamus declaring the seizure of lorry bearing No.AP 21-TZ-1229, as illegal, contrary to G.O.Ms.No.42 dated 29.03.2016 and unconstitutional.

The Assistant Government Pleader, on instructions, submits that at present the vehicle is with the 5th respondent and if the petitioner approaches respondents 3 to 5, the case of petitioner will be considered in terms of G.O.Ms.No.42 and appropriate decision taken. The statement is placed on record. The petitioner is given liberty to forthwith represent to respondents 3 to 5 for release of vehicle in accordance with law, the same will be considered and orders passed within three days thereafter.

The writ petition is disposed of accordingly. No order as to costs.
