HONOURABLE SRI J USTICE SURESH K UMAR K AIT CRIMINAL PETITION No. 16350 of 2016 ORDER:

Vide present Criminal Petition, the petitioner/Accused No.1 seeks bail in S.C.No.179 of 2014 pending trail on the file of learned II Additional Sessions Judge, Kadapa, at Proddatur, YSR Kadapa District which arises out of Crime No.80 of 2013 registered on the file of Station House Officer, III Town Police Station, Proddatur, YSR Kadapa District for the offences punishable under Sections 147,148,342,364-A,365,323, 386, 506,109 read with Section 149 IPC and Sections 3 and 4 of AP Control of Organized Crime Act, 2001.

It is not in dispute that the petitioner was enlarged on bail by this Court in Crime No.80 of 2013 through order dated 21.09.2013 passed in Criminal Petition No.10526 of 2013. However, as the petitioner is an accused in Crime No.125 of 2014, he was arrested and sent to judicial remand, due to which, he could not attend the Court of learned Assistant Sessions Judge, Proddatur, for adjournment in respect of the present crime. Therefore the learned Assistant Sessions Judge issued NBWs against the petitioner. Being aggrieved by the same, the present petition is filed,.

Having heard the learned Counsel on either side and gone through the material on record, it is axiomatic that the petitioner is

involved in 18 cases, however, in five cases, the petitioner has been acquitted, in one case he has been convicted and sentenced to undergo simple imprisonment for ten months and the rest of cases are pending trial.

The petitioner is a habitual offender. Since several cases are registered against him, he is required to appear before different courts. Therefore, it is proper course for him to keep in jail in order to attend different courts where cases are pending trial against him, otherwise, he will suffer another N.B.W. The Criminal Petition is dismissed.
