THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO.7667 OF 2023 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioners/Accused Nos. 1 & 2 in SC No.06 of 2023 on the file of Principal Sessions Judge, Mahabubabad, registered for the offence under Section 8 (c) r/w. 20 (b) of Narcotic Drugs and Psychotropic Substances Act, 1985 (for short 'the NPDS Act').

Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the respondent-State and perused the record.

It is alleged that these petitioners were found transporting dry ganja on 28.11.2022. The police have conducted proceedings in the presence of independent witnesses and seized 70 kgs of contraband. Entire investigation is complete and charge sheet is filed and the same is not disputed by the learned Public Prosecutor. 4.
Since the trial in the case is likely to take considerable period and also in the back ground of the petitioners not being involved in any other criminal cases, which is not disputed by the learned
Public Prosecutor, this Court deems it appropriate to grant relief of regular bail to the petitioners/A1 & A2 subject to following conditions:
i) The petitioners/Accused Nos.1 & 2 shall be released on bail on furnishing personal bond for a sum of Rs.50,000/- (Rupees Fifty thousand only) with two sureties i.e., one local surety and the other from the Home town, for a like sum each to the satisfaction of Principal Sessions Judge, Mahabubabad.
ii) The petitioners/Accused 1 & 2 after release shall appear before the trial Court on every date of hearing, failing which the police are at liberty to seek cancellation. 5.
