HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.180 of 2017 ORDER:

This writ petition is filed by petitioner seeking to direct the 2nd respondent to process the application of the petitioner, without insisting for "No objection certificate from the Revenue Authorities due to pendency of L.G.C.No.29 of 2006 before the Special Court. 2.

Heard and perused the material available on record. 3.

It is brought to the notice of this Court that this case is squarely covered by the decision rendered by this Court in W.P.No.12861 of 2007. A copy of the order dated 16.11.2007 passed in the aforesaid writ petition is placed on record.

For reasons alike as were stated in the afore-stated order and in terms thereof, the Writ Petition is disposed of directing the 2nd respondent to reconsider the application of the petitioner for granting building permission in accordance with law and without reference to the pending L.G.C.No.29 of 2006. However, in the event the L.G.C. case, which is pending before the Special Court, is decided against the petitioner, it shall not claim equities or compensation for the cost of the building constructed by it.
