Smt. A, Bharathi v. Union Of India
THE HON'BLE SRI JUSTI CE SANJAY KUMAR AND THE HON'BLE SRI JUSTI CE T. AMARNATH GOUD W.P.No.18541 of 2018 ORDER:
(Per Sanjay Kumar, J) There was no representation for the petitioner or her learned counsel when the matter was taken up for hearing on 04.7.2019 and again on 26.7.2019. It was accordingly directed to be posted 'for dismissal' on 30.7.2019. Today, the matter appears under the caption 'For Dismissal'. We are however informed that Sri R.Siva Sai Swarup, learned counsel for the petitioner, shifted his practice to Andhra Pradesh High Court. An adjournment is sought on that ground. We are not persuaded to accept the request as it is for the party to make alternative arrangements in the event the counsel is no longer available. Having secured an interim order, it is not open to a party to fail to take steps for adequate representation when the case is taken up for hearing. The Writ Petition is accordingly dismissed for non-prosecution. Interim order dated 07.06.2018 shall stand vacated.
Miscellaneous Petitions pending in this Writ Petition shall also stand dismissed. No order as to costs.
