THE COURT MADE THE FOLLOWING:

ORDER:

This writ petition is filed for the following substantive relief: "...to issue any appropriate Writ, Order or direction, more particularly one in the nature of Writ of Mandamus declaring the action of the respondents herein in obstructing and interfering with the execution work allotted to the petitioner society in respect of Akkivaram Ramp, situated in Amadalavasa Mandal, Srikakulam District, without following due process of law, as illegal, arbitrary, highhanded and violation of principles of natural justice and

consequently direct the respondents to permit the petitioner to lift the sand from the Akkivaram Ramp till fulfilment of the contract entered into to deliver 2,656 out of 3,356 cubic's to the customers by permitting the petitioner to complete the pending delivery loads, in the interest of justice."

At the hearing, Mr. M. Krishna Rao, learned counsel for the petitioner, requested for permission to withdraw the writ petition with liberty to his client to file a fresh writ petition.

The writ petition is accordingly dismissed as withdrawn with the liberty in terms of the prayer made.

As a sequel to dismissal of the writ petition, W.P.M.P. No.2976 of 2016 shall stand disposed of as infructuous.
