THE HON'BLE SRI JUSTICE T.AMARNATH GOUD W.P.NO.10819 OF 2006 ORDER:
This writ petition is filed seeking to declare the action of the respondents in undertaking excavation work for formation of tank in petitioner's land of Ac.4.23 cents covered by Sy.No.505 of Adenapalli Village, Pakala Mandal, without acquiring the same and without paying compensation as illegal, irregular, high handed, arbitrary and violative of articles 14, 19, 21 and 300A of Constitution of India and consequently direct the respondents not to excavate for any tank in the petitioner's land without acquiring the same and without paying any compensation. 2.
It is the case of the petitioner that the subject land was intended to acquire for formation of a tank and excavation work has been undertaken. At that juncture, the present writ petition has been filed and to compensate the petitioner, the respondents have issued patta, allotting alternative agricultural lands. 3.
Now, it is the case of the petitioner that he is in possession of his own land and he does not require the land allotted by the respondents by way of patta in D-Form-7 in Vaddepally Village, Pakala Mandal, Chittoor District, Sy.N.364/2, in an extent of Ac.4.30 cents dated 13-7-2007 and he will surrender the same to the Government.

Recording the above submission, the writ petition is disposed of with a direction to the respondents to take back D-Form Patta dated 13-7-2007 of the lands allotted to the petitioner in lieu of the lands acquired from him and the petitioner shall complete the formalities in this regard and he shall continue to be in possession of his lands which are the subject matter of this writ petition. No order as to costs. As sequel, the miscellaneous petitions pending if any shall stand closed.
