This writ petition is filed questioning the action of the 2nd respondent in issuing Look Out Circular (LOC) No.

1/SIC/ACK/LOC/201 dated 24.5.2019 against the petitioner.

It is stated by the petitioner that he is a permanent resident of United States of America (USA) and had come to India on a short visit and by virtue of LOC issued by the 2nd respondent, he is unable to proceed back to USA to undertake his regular job responsibility and therefore sought to quash the same. 3.

In this regard, this Court by judgment in W.P.3213 of 2015 was pleased to hold that when a LOC is issued, it is always open to the person to whom such LOC is issued, to approach either before the authority who has issued the same or before appropriate Court if any C.C. is pending. In this case, since no C.C. is filed as yet, it is always open to the petitioner to approach the 2nd respondent by submitting an explanation and seek for lifting of LOC. 4.

Learned counsel for petitioner submits that the petitioner would undertake such exercise and seeks a direction to the 2nd respondent to consider the said explanation at the earliest. 5.

Having regard to the above, the writ petition is disposed of, giving liberty to the petitioner to file representation before the 2nd respondent for lifting of LOC within a period of two weeks from today and upon filing such representation, the 2nd respondent

shall consider the same and pass appropriate orders, in accordance with law, as expeditiously as possible. As a sequel, the miscellaneous applications, if any, shall stand closed. There shall be no order as to costs.
