HON'BLE SRI JUSTICE R. KANTHA RAO W.P.No.6766 of 2015 ORDER:

Heard learned counsel appearing for the petitioner and learned Government Pleader for Civil Supplies appearing for respondents 1 to 5.

This Writ Petition is filed seeking to declare the action of the 3rd respondent in suspending the authorization of the petitioner, as arbitrary and illegal.

The authorization of the petitioner was suspended by order dated 08.01.2015 on the allegation that certain variations were found in the stocks of rice and sugar, at the time of inspection. In the impugned order, the authority recorded a finding that there is prima facie material warranting suspension of the petitioner's authorization.

Since the suspension order was passed pending enquiry, this Court is not inclined to go into the merits of the case. However, having regard to the submission made by the learned counsel appearing for the petitioner that the impugned order does not indicate the period of suspension, this Writ Petition is disposed of directing the 3rd respondent to complete the enquiry and pass final order within a period of eight weeks from the date of receipt of a copy of this order. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
