THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 5001 of 2015 ORDER:

The grievance of the petitioner is limited to the extent of enrolling him in the Voters List.

It is the case of the petitioner that on 12.05.2014 he made an application, along with his family members, in the prescribed form under Section 22 read with Rule 13 of the Representation of People Act, 1951 (for short, 'the Act') for inclusion of his name in the Electoral Rolls of Kesavarapadu village, Karamchedu mandal, Prakasam district, but the respondent authorities have not enrolled his name till date; and hence prays for a direction to the respondents to expedite action on inclusion of his name in the voters list in view of the ensuing elections to the Gram Panchayat.

Learned counsel for respondents 3 and 4, on instructions, submits that earlier the petitioner made an application vide ID No.22354153, consequent to which his application was sent to the Village Revenue Officer (Booth Level Officer) for enquiry and report; and the Booth Level Officer submitted a report stating that the petitioner is ordinarily a resident of Kesavarappadu village but he was not available at the time of enquiry and no proof was produced with regard to his Date of Birth. Hence based on the report of the Booth Level Officer, the petitioner's application was rejected. The counsel further submits that the petitioner once again submitted an application bearing I.D.No.AP104101439 on 12.01.2015 for inclusion of his name in the voters list of 104 Parchur Assembly Constituency, and his application is under scrutiny and necessary steps would be taken up shortly.

4. In view of the submissions made, and considering the possibility of issuance of notification for elections to the Gram Panchayat for filling up

the vacant post of Sarpanch, the writ petition is disposed of with a direction to the respondent authorities to process the application of the petitioner within two weeks from the date of receipt of a copy of this order. No costs.

Miscellaneous petitions, if any pending in this writ petition, shall stand closed.
