THE HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO Writ Petition No.18794 of 2015 ORDER:

The petitioner was appointed as a fair price shop dealer of Shop No.150 of Karimnagar Town and District. While so, the second respondent-Revenue Divisional Officer, Karimnagar, issued a show cause notice to the petitioner on 23.02.2015 stating that the Assistant Grain Purchasing Officer, Karimnagar submitted a report on 10.02.2015 alleging that on inspecting the fair price shop of the petitioner, he found that there is some variation in the quantity. The petitioner submitted an explanation on 05.03.2015 and the stock for the month of February 2015 was not released. However, the second respondent called for a report from the third respondent-Tahsildar, Karimnagar Mandal, through letter dated 16.04.2015, whereupon, the third respondent conducted the enquiry and recommended for continuance of the petitioner to run the fair price shop.

In spite of the same, the stock was not released and aggrieved by the said action, the present writ petition is filed. The learned Government Pleader for Civil Supplies, on the basis of instructions, submits that 6-A proceedings are initiated against the petitioner and no disciplinary proceedings are pending against him. Therefore, this Court is of the opinion that so long as authorization is in force, the petitioner is entitled to receive the stock for distribution of essential commodities to the cardholders. In the circumstances, the writ petition is allowed and the respondents 2 & 3 are directed to supply the stock as per the authorization of the petitioner, if his authorization is in force as on

today. Miscellaneous Petitions, if any pending in this writ petition, shall stand closed. No order as to costs.
