This Writ Petition is filed assailing the action of the 3rd respondent in passing the impugned order dated 01.06.2018 in File No.C/459/2018 without giving an opportunity in compliance of the order dated 29.03.2018 in WP No.10484 of 2018 passed by this Court.
Heard learned counsel for the petitioner and learned Government Pleader for Labour Department appearing for respondents 1 to 3.
Though notice is issued and served on the 4th respondent, there is no representation on behalf of the 4th respondent. Learned counsel for the petitioner submits that earlier writ petition i.e., W.P.No.10484 of 2018 was filed by the petitioner and this Court disposed of the same on 29.03.2018 directing the 3rd respondent to dispose of the same after giving an opportunity of hearing to both parties. He submits that the impugned order dated 01.06.2018 is passed without affording an opportunity of hearing to the petitioner.
A perusal of the impugned order goes to show that no opportunity of hearing was given to the petitioner as per the orders of this Court in WP No.10484 of 2018, which is in violation of principles of natural justice.
Only on the ground of violation of principles of natural justice, the impugned order dated 01.06.2018 is set aside and the
3rd respondent is directed to reconsider the issue after issuing notice to both parties i.e. petitioner as well as to the 4th respondent and take action in accordance with law. With the above direction, this Writ Petition is disposed of. There shall be no order as to costs. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed.
