HONOURABLE SRI JUSTICE RAJA ELANGO CIVIL REVISION PETITION No.5901 of 2016 ORDER:

This revision is filed by the petitioner challenging the judgment dated 14.9.2016 passed by the District Judge, Rajamahendravaram in ATA No.12 of 2016.

Originally, the petitioner along with another filed an application in I.A.No.285 of 2013 before the Special Officer-cum-Junior Civil Judge, Pithapuram for grant of temporary injunction against the respondents restraining them from ever interfering with his peaceful possession and enjoyment of tenancy rights over the petition schedule property. The learned Special Officer dismissed the said application. Aggrieved by the same, the petitioner filed the above ATA. The said ATA was also dismissed. Hence, the petitioner filed this revision. 3.

After arguing for some time, the learned Counsel for the petitioner submitted that a direction may be given to the learned Special Officer to dispose of the ATC as expeditiously as possible, while directing both the parties to maintain status quo.

Considering the facts and circumstances of the case and the submission made by the learned Counsel for the petitioner, this Court is inclined to dispose of this revision petition with the following directions: (i) The Special Officer-cum-Junior Civil Judge, Pithapuram is directed to dispose of ATC No.1 of 2013 within a period of six months from the date of receipt of a copy of this order. (ii) All the parties are directed to maintain status quo in respect of the petition schedule property.

With the above directions, the Civil Revision Petition is disposed of. No costs. Consequently, miscellaneous petitions pending, if any, shall stand closed.
