THE HON'BLE SRI JUSTICE T.VINOD KUMAR WRIT PETITION No.21548 of 2019 ORDER:

The present writ petition is filed to declare the inaction of the 4th respondent-Station House Officer, Nelakondapally Police Station, Khammam District in taking any action against the accused named in the complaint or taking any steps in investigating into the Crime No.186 of 2019, as being illegal, arbitrary and violative of Articles 14 and 21 of the Constitution of India.

Heard Sri Sushil Kumar Pandey, learned counsel for the petitioner and the learned Assistant Government Pleader for Home appearing for the official respondents 1 to 4. The learned Assistant Government Pleader for Home, on the basis of written instructions dated 14.10.2019, a copy of which is placed on record of this Court, submits that basing on the complaint of the petitioner, a case was registered in Crime No.186 of 2019 of Nelakondapally Police Station for the offences punishable under Sections 447, 427, 294-B, 323 and 506 read with Section 34 of the Indian Penal Code, 1860 on 12.09.2019. On the basis of written instructions, it is further stated that during the course of investigation, LWs.1 and 2 were examined and their statements were recorded and notice under Section 41-A of the Criminal Procedure Code was also issued to the accused persons on 26.09.2019. Home that investigation in this case is completed and final report will be filed before the concerned Court shortly. Having regard to the said submissions made on behalf of 4th respondent, no further orders are required to be passed in this writ petition, except observing that since the investigation is already completed, the final report shall be filed before the concerned Court as expeditiously as possible, in any event not later than within a period of six weeks from the date of receipt of a copy of this order.

Accordingly, with the above direction, the writ petition is closed. However, there shall be no order as to costs. As a sequel thereto, miscellaneous applications, if any, pending in this writ petition shall stand closed. ___________________ T. VINOD KUMAR, J Date: 05.12.2019 Isn
