THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO CIVIL REVISION PETITION No.2894 of 2015 ORDER:
The petitioner herein is Judgment Debtor No.5 in E.P.No.107/2015 in Dispute No.574/2013 on the file of the learned VII Additional Senior Civil Judge, Rangareddy District at L.B.Nagar. The said execution proceedings arose out of the proceedings under the Chit Funds Act, 1982. When the lower Court passed an order on 28.04.2015 issuing warrant of process through Court, the present Civil Revision Petition was filed.
Learned counsel for the petitioner submits that he was not put on notice with regard to the arbitration proceedings initiated under the Chit Funds Act, 1982, and when he filed an application for certified copy of the documents in the lower Court, it was noticed that the lower Court record did not contain any document other than E. P. No.107/2015.
Learned counsel appearing for respondent No.1 submits that in the arbitration proceedings steps were taken to serve the petitioner through substitute service by publishing the notice in a local newspaper.
Be that as it may, now by the impugned order dated 28.04.2015 a notice was issued to the respondents and it is open to the respondents to take necessary steps in accordance with law. In view of the stay granted by this Court on 31.07.2015, the stay shall be continued for a period of two more weeks from today and liberty is given to the petitioner to file an appropriate application before the Executing Court, raising all the pleas that are available to him in accordance with law, within the said period.
Accordingly, this Civil Revision Petition is disposed of. No order as to costs.
Miscellaneous Petitions, if any, pending in this Civil Revision Petition shall stand closed.
