THE HON'BLE SRI JUSTICE RAMESH RANGANATHAN AND THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY Writ Petition No.18729 of 2016 ORDER: (per Hon'ble Sri Justice Ramesh Ranganathan) Sri M.Venkatram Reddy, learned counsel for the petitioner, would submit that a copy of the order passed by the Deputy Commissioner dated 04.09.2015 was handed over to the petitioner across the Bar on 15.06.2016 and as the petitioner is unaware of the order prior thereto, it would suffice if this Court were to permit them to withdraw the writ petition granting them liberty to question the said order in accordance with law.
Sri S.Suri Babu, learned Special Standing Counsel for Commercial Taxes, would, however, contend that the order was served on the assessee much earlier.
In any view of the matter, as the petitioner seeks to withdraw the writ petition to question the order passed by the Deputy Commissioner dated 04.09.2015, the writ petition is dismissed as withdrawn granting liberty as sought for. The miscellaneous petitions pending, if any, shall also stand dismissed.
