HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO WRIT PETITION No.3774 of 2017 ORDER :

This writ petition was filed challenging the inaction of respondent Nos.2 and 3 in failing to conduct any investigation pursuant to the registration of Crime in F.I.R.No.1527 of 2015 dated 11.12.2015 by recovering the original documents from respondent No.4.

Respondent No.3 filed counter stating that the investigation is under progress and the Investigating Officer examined the complainant/petitioner herein and recorded his detailed statement. It is further stated in the counter that when the investigation is under progress, respondent No.4 filed Criminal Petition No.4243 of 2016 before this Court and this Court disposed of the said criminal petition on 29.03.2016 directing the police concerned to complete the investigation and file a final report, if any, without arresting the accused, and in the event of necessity, the police concerned were directed to issue notice to the accused for appearance before the investigating agency for the purpose of investigation. Pursuant to the said order, the Investigating Officer issued a notice under Section 91(1) Cr.P.C. on 07.04.2016 to respondent No.

4 and respondent No.4 submitted a reply on 11.04.2016 by appearing in person before the concerned Investigating Officer. It is further stated that another notice was also issued on 20.07.2016, to which, respondent No.4 submitted a reply on 22.07.2016, and again, a notice was issued on 18.01.

produce the documentary evidence and in view of the non-cooperation of respondent No.4, a Memo dated 01.02.2017 was filed before the II Metropolitan Magistrate, Rachakonda, Ranga Reddy District at L.B.Nagar on 07.02.2017 seeking to issue summons to respondent No.4.

In view of the above developments, it cannot be said that the police are not investigating the crime properly. In view of the order dated 29.03.2016 in Criminal Petition No.4243 of 2016, the police are directed to complete the investigation as expeditiously as possible. 4.

With the above observation, the Writ Petition is disposed of. No costs.
