Heard Sri K. Ram Reddy, learned counsel for the petitioner and Sri C. Appayya Sharma, learned Standing Counsel for the respondents. 2.

Pursuant to the tenders invited by the respondents, petitioner herein submitted his tender for supply of KCR Kits to Government Hospital. The respondents sought for a clarification regarding blacklisting in A.P. Civil Supplies Corporation Limited for non supply of RG Dal vide Proceedings No.MKtg/M6/1523/2015-16, dated 04.07.2016. Responding to the said communication sent by the respondents, petitioner herein submitted a representation on 30.03.2017. In the said representation it is stated that the petitioner herein represented to the VC&MD APSCSCL requesting to revoke the orders of black-listing apart from release of penalty amount recovered. It is further stated that VC & MD APSCSCL was kind enough in releasing the penalty amount to M/s.Kendriya Bhandar, Vizag considering the reasons explained. It is also further stated by the learned counsel for the petitioner that on 01.02.2017 the APSCSCL issued a supply order. According to the learned counsel for the petitioner the very issuance of supply order shows that he is not continuing in the black list.

Since the representation dated 30.03.2017 is pending consideration before the respondents herein, this Court deems it appropriate to dispose of the present writ petition with a direction to the respondents herein to consider the said representation dated 30.03.2017 said to have been submitted by the petitioner herein to the second respondent herein, for

taking necessary action in the matter and for passing the orders before proceeding further with the subject tenders.

With the above observations, the writ petition is disposed of. As a sequel, miscellaneous petitions, if any, shall stand disposed of. There shall be no order as to costs.
