HON'BLE SRI JUSTICE P. KESHAVA RAO CRIMINAL REVISION CASE No.1356 of 2018 ORDER:
Heard the learned counsel appearing for the petitioner as well as the first respondent.
The present criminal revision case is filed questioning the orders dated 06.03.2018 passed in M.C.No. 324 of 2016 on the file of the Court of the Addl. Metropolitan Sessions Judge for the Trial of Jubilee Hills Car Bomb Blast Case-cum-Addl.Family Court-cum-XXIII Addl. Chief Judge-cum-IX Addl. Metropolitan Sessions Judge, Hyderabad, awarding maintenance @ Rs.25,000/ - per month from the date of the petition i.e. 30.06.2016 in favour of the first respondent.
The facts of the case are that the first respondent herein filed M.C.No. 342 of 2016 on the file of the above said Court. On contest, the said maintenance case was allowed on 6.03.2016 awarding Rs.25,000/ - per month towards maintenance payable by the petitioner herein from the date of the petition. Aggrieved by the same, the present criminal revision case is filed. Pending the criminal revision case, an application in I.A.No. 2 of 2018 has been filed by the first respondent seeking permission of this Court to compound the offence and allow the criminal revision case.
In the affidavit as well as the joint memo filed by the parties, it is mentioned that during the pendency of the revision case, at the intervention of elders and well wishers, the matter has been amicably settled and they have executed a settlement deed
dated 25.06.2018 under which the petitioner has paid a sum of Rs.3,36,000/ - towards full and final settlement which includes her fair and better provision, permanent alimony, future maintenance of herself including her mehar and iddat period maintenance. In these circumstances, I.A.No. 2 of 2018 is ordered. The parties appeared before the Court have been identified by their respective counsel and their photo identity cards are also filed in the Court apart from the settlement deed dated 25.06.2018. The same are made as part of the record.
In view of the orders passed in I.A.No.2 of 2018, the criminal revision case is allowed setting aside the orders dated 06.03.2018 passed in M.C.No. 324 of 2016 on the file of the Court of the Addl.Metropolitan Sessions Judge for the Trial of Jubilee Hills Car Bomb Blast Case-cum-Addl.Family Court-cum-XXIII Addl.Chief Judge-cum-IX Addl. Metropolitan Sessions Judge, Hyderabad, awarding maintenance @ Rs.25,000/ - per month from the date of the petition i.e. 30.06.2016 in favour of the first respondent.
