Ramayanam Subba Rao v. Buddaraju Raghavaraju (Died)
THE HON'BLE SRI JUSTICE M.S. RAMACHANDRA RAO CIVIL REVISION PETITION No.3980 of 2017 ORDER :
This Revision is filed by the petitioner assailing the order dt.07-06-2017 in O.S.No.415 of 2017 of the Senior Civil Jude, Bhimavaram.
2.
Petitioner is plaintiff in the said suit, which is filed by him for declaration of his title and for a perpetual injunction. 3.
During the course of his evidence, he sought to rely on a document dt.05-12-1991 which is unstamped and unregistered. Objection was taken for its marking by respondents and the trial Court sustained the said objection holding that the said document cannot be marked in evidence and cannot be looked into for any purpose because it is unstamped and it is also unregistered.
4.
Assailing the same, this Revision is filed.
5.
Though learned counsel for petitioner contended that this document is a link document to petitioner's title deed, since it is unstamped and unregistered, it cannot be looked into for any purpose and the Court below was right in not permitting the document to mark in evidence. I do not find any error of jurisdiction in the order passed by the Court below.
MSR,J C.R.P.No.3980 of 2017 - 2 - 6.
Accordingly, the Civil Revision Petition is dismissed at the stage of admission. No costs.
7.
Miscellaneous applications pending if any in this Revision shall stand closed.
