THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 21656 of 2019 ORDER:

In this Writ Petition, petitioners' grievance is that respondent Nos.2 to 4 are not acting on their representation dated 29.08.2019.

A perusal of the petitioners' representation dated 29.08.2019 discloses that they filed a suit, being O.S.No.1759 of 2016 in the Court of IX Senior Civil Judge, Ranga Reddy District at L.B. Nagar, against respondent Nos.5 to 7 for perpetual injunction, and it is pending.

As the petitioners have already sought injunctive relief and the said suit is pending and as they have asserted that they are in possession of the subject property, the question of respondent Nos.5 to 7 making any construction in the subject property without there being any permission does not arise. In the light of the fact that the aforesaid suit filed by the petitioners against respondent Nos.5 to 7 is pending, if any observation is made by this Court in this Writ Petition, it may jeopardize the interests of the petitioners as well as respondent Nos.5 to 7, who are parties to the aforesaid suit.

CKR, J W.P.No.21656 of 2019 In those circumstances, leaving it open to the petitioners to workout the remedies in the pending suit or in any other proceedings before the appropriate civil Court, this Writ Petition is closed.

Miscellaneous Petitions, if any pending, shall stand closed. There shall be no order as to costs.
