HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.18790 OF 2018 O R D E R :

This writ petition is filed challenging the action of the 3rd respondent in interfering with the civil dispute pending between the petitioner and 4th respondent and in directing the petitioner not to enter into the land to an extent of Ac.5.60 cents, in Survey No.102, situated at Vadravannuru Village, Rayadurg Mandal, Anantapur District without having any jurisdiction.

Heard learned counsel for the petitioner.

Learned Assistant Government Pleader for Home produced written instructions stating that the respondents are not interfering with the civil dispute pending between the petitioner and 4th respondent in OS.No.110/2017 filed by the 4th respondent against the petitioner. It is further stated that a case is registered against the petitioner in Cr.No.129/2017 under Section 324, r/w 34 IPC wherein the 4th respondent is the complainant.

In the writ affidavit also it is stated that subsequent to the registration of crime against the petitioner in Cr.No.129/2017, charge sheet is filed and the same is numbered as CC.No.298/2017 on the file of the Judicial First Class Magistrate, Rayadurg in respect of crime registered

against the petitioner. But the said aspect is not stated in the written instructions.

Learned counsel for the petitioner states that in the suit filed by the 4th respondent, initially, injunction was granted by the Court below in IA.No.856/2017, but the same was vacated subsequently and inspite of the same, the police are interfering with the civil rights of the petitioner. It is to be seen that when charge sheet is filed in respect of crime registered against the petitioner and the same is numbered as CC.No.298/2017 on the file of the Judicial First Class Magistrate, Rayadurg, there is no need to the police to interfere with the civil disputes.

In view of the same, the writ petition is disposed of directing the respondent police not to interfere with the civil dispute pending between the petitioner and 4th respondent. No order as to costs.

As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed. _______________________________ A.RAJASHEKER REDDY, J 18.06.2018 t k.
