HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 33050 OF 2011 ORDER:

Heard learned counsel for the petitioners and learned Government Pleader for Revenue. With the consent of both parties, the present writ petition is disposed of at the admission stage itself. The present Writ Petition came to be filed seeking to declare the action of the respondents in interfering with the petitioners' land admeasuring Acs.85.50 cents in Survey No.679 situated at Gogulapalli Village, Allur Mandal, SPSR Nellore District as illegal and arbitrary. The averments in the affidavit would show that the petitioners made an application for mutation of their names in the revenue records and the authorities after conducting a detail enquiry, issued pattadar pass books and title deeds in their favour. Loans were also obtained from Bank basing on the said documents.

It is stated that though the petitioners are in possession of the land, the respondents are trying to enter into the land and that they have conducted a survey in the first week of December, 2011. It is further stated that respondents forcibly entered into the land and when the petitioners objected, the respondents left the place stating that they will come again and resume the land. Hence the present Writ Petition. At the time when the matter is taken up, learned Government Pleader for Revenue, basing on the instructions received by him from the Tahsildar, Allur, states that the land is still in possession of the petitioners and the respondents are not interfering with the possession and enjoyment of the same.

Recording the submission made by the learned Government Pleader for Revenue, the Writ Petition is disposed of directing the respondents not

to interfere with the property in possession of the petitioners except in accordance with law. No costs.

Consequently, the Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
