Trade Union Coordination Centre, Hyderabad.
... Petitioner And Union of India and another.
... Respondents COUNSEL FOR PETITIONER : Mr. B. Praveen Kumar Reddy for Mr. P. Shashi Kiran COUNSEL FOR RESPONDENTS : Mr. R. Venkatesham for Mr. S. Janardhan Goud, Addl. SC for CG A.G.P. for Labour (T.S.) THE COURT MADE THE FOLLOWING:
ORDER : (per Hon'ble Sri Justice C.V. Nagarjuna Reddy) This writ petition is filed for a Mandamus to declare the action of the respondents in not considering the petitioner's representation dated 16.05.2018 for incorporating its name in their records in terms of the Lok Adalat Award dated 03.05.2018 made in O.S.No.2896 of 2015 on the file of the XX Junior Civil Judge, City Civil Court, Hyderabad, as arbitrary and illegal. Though the learned Standing Counsel for the respondent No.1 is unable to assist the Court, we are, however, not inclined to adjudicate this writ petition on merits for the reason that the petitioner has an effective alternative remedy of seeking execution of the Lok Adalat Award dated 03.05.2018, for enforcement of which the present writ petition is filed, under Section 21 of the A.P. State Legal Services Authorities Act, r/w. Rule 18 of the A.P. State Legal Services Authorities Rules, 1995.
In view of availability of effective alternative remedy, the writ petition is dismissed with liberty to the petitioner to avail the aforementioned alternative remedy. No order as to costs.
As a sequel to the dismissal of the writ petition, I.A.No.1 of 2018 shall stand disposed of as infructuous.
