THE HON'BLE DR. JUSTICE B.SIVA SANKARA RAO CRIMINAL PETITION No.9692 OF 2017 ORDER:

Heard learned counsel for the petitioner/A5 - owner of the lorry bearing No.AP 16W 0844, that was carrying the Black Jaggery of 6312 Kgs, of Crime No.173 of 2017, registered by SHO, Prohibition & Excise, Zaheerabad, for the offences punishable under Section 34(e) of the A.P.Excise Act, 1968, it is on the premise that the Black Jaggery is not for consumption otherwise but for preparing the illicit liquor and also heard the learned Public Prosecutor, representing the respondent - State and perused the panchanama and the grounds urged in the quash petition and the other material on record.

There is nothing to interdict the investigation from the above, much less, to keep the petition pending, but for to say, the petitioner shall not be arrested pending investigation, however, it will not prevent the police to secure the presence of the accused as and when required for purpose of investigation.

Accordingly and with the above direction, this criminal petition is disposed of. Miscellaneous petitions pending consideration, if any, in this case shall stand closed in consequence.
