B.Komal Reddy v. 1.The State Of Telangana
THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION NO.29180 OF 2016 O R D E R :
This writ petition is filed aggrieved by the action of the respondents in not allowing the petitioner to enter into the peaceful possession of the land admeasuring Ac.3-00 guntas in Sy.No.972 situated at Challuru Village, Veenavanka Mandal, Karimnagar District in pursuance of the Memo No.K/13419/2014 dated 17.08.2016 and trying to release the amount deposited in the revenue deposits in favour of the respondents 4 and 5 without considering the representation dated 22.08.2016. Heard both sides.
The petitioner claims to be the owner of the subject land basing on certain documents. All these aspects cannot be gone into in the writ petition as the petitioner has an alternative remedy of filing a civil suit in the competent Civil Court. In view of the same, I am not inclined to entertain the writ petition. Accordingly, the writ petition is dismissed granting liberty to the petitioner to approach the competent Civil Court in respect of his grievance. The amounts mentioned in Memo No.K/13419/2014 dated 17.08.2016 shall not be released for a period of eight (08) weeks enabling the parties to approach the Civil Court. No costs. As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
