THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 21702 of 2019 O R D E R:

In this writ petition, petitioner challenges the proceedings dated 02.07.2019 issued by respondent No.4-SubCollector/Revenue Divisional Officer (In-charge Joint Collector) Khammam.

Heard learned counsel for the petitioner and learned Government Pleader for Civil Supplies appearing for the respondents.

From a reading of the impugned proceedings, it is clear that the petitioner has not distributed the kerosene as per the allotment and he retained the stock with him, as such, he was issued a show cause notice on 04.06.2019, to which, he submitted his explanation on 27.08.2019.

Inasmuch as the petitioner has submitted his explanation, the respondent authorities ought to have passed final orders after giving opportunity to the petitioner. For what reason the petitioner retained the stock is required to be considered after considering the explanation submitted by the petitioner. There cannot be any indefinite suspension of the dealership as the same would affect the livelihood of the petitioner.

In those circumstances, the writ petition is disposed of with the direction to respondent No.4 to consider the explanation submitted

by the petitioner and pass orders within a period of two weeks from the date of receipt of a copy of this order. If respondent No.4 fails to pass orders within the time stipulated above, the impugned order shall stands suspended.

Miscellaneous petitions, if any, pending in this writ petition shall also stand disposed of. There shall be no order as to costs. _________________________ CHALLA KODANDA RAM, J Dt:30.09.2019 kdl
